1.Definitions
For the purpose of these Terms and Conditions, capitalized terms have the following meaning:
- "Turfdex" or "the Site": the website accessible at
turfdex.comand its subdomains, together with all software, editorial content, database and associated functionality. - "Operator": Kevin Barrios, a natural person who owns and is responsible for the Site, domiciled in the City of Buenos Aires, Argentine Republic.
- "User": any natural person who accesses the Site, with or without a registered account, and uses any of its features.
- "Editorial content": profiles, biographies, stories, glossary, calendar, tables, images and other material curated, drafted or selected by the editorial team of the Site.
- "User contribution": any text, image, data, suggestion, error report or material the User submits to the Site through the forms provided for that purpose.
- "Account": the registration linked to a person, created when signing in through a federated identity provider.
2.Acceptance of the Terms
Use of the Site implies acceptance of these Terms and Conditions, as well as the Privacy Policy and the Cookie Policy, which form an integral part of this document.
If you act on behalf of a legal entity, you represent you have sufficient authority to bind it to these Terms. If you do not agree with any of these provisions, you must refrain from using the Site. Continued use of the Site after a modification published in accordance with the "Modifications to these Terms" section implies acceptance of the new version.
3.Nature of the service
Turfdex is a collaborative-information site about Argentine horse racing, organised under a wiki model with editorial curation. Its purpose is to build and maintain a layer of expertise and knowledge over public data — horses, jockeys, studs, racetracks, races, trainers and related events — complemented by verifiable community contributions.
The Site is offered free of charge and does not require registration to consult public content. Creating an account is optional and enables additional features such as submitting contributions, suggestions and reports.
The Operator may, in the future, introduce paid features, subscription models or premium services. In such case, the specific conditions for those services will be communicated clearly before any contracting and will be understood as complementary — not replacing — these Terms.
4.The Site is not a betting platform
Turfdex is not, nor does it intend to be, a site for betting, gambling or any kind of financial intermediation. On the Site:
- No bets are received, processed or managed.
- No predictions, picks, betting recommendations or "tips" are published.
- No participation in games of chance is encouraged.
- No advertising, sponsorship or commercial agreements with betting operators are accepted.
Historical, statistical and biographical information published is exclusively informational, documentary, educational and cultural in nature. It must not be interpreted as advice, recommendation or invitation to participate in games of chance, betting, financial transactions or investment decisions. Any use of Site information for betting purposes is the sole responsibility of the User and falls outside the Operator's scope of liability.
5.Accounts and registration
To submit contributions, suggestions or reports, an account is required. Registration is performed through a federated identity provider (currently Google), as described in the Privacy Policy.
When creating an account, the User declares and warrants that:
- They are at least sixteen (16) years of age.
- Their account information is true, accurate and kept up to date.
- They do not act on behalf of a third party without sufficient authorization.
- They are solely responsible for the use of their account and any activity carried out under it.
- They will keep the credentials of the identity provider confidential and will notify the Operator immediately of any unauthorized use.
The User may request account deletion at any time by writing to contacto@turfdex.com. Deletion will involve erasure of identifiable personal data subject to the periods and exceptions described in the Privacy Policy.
6.Conduct and acceptable use
The User agrees to use the Site in good faith, in accordance with these Terms, applicable law and respect for third-party rights. In particular, the User shall not:
- Use the Site for unlawful, fraudulent, defamatory, discriminatory purposes or in ways that infringe third-party rights.
- Submit Contributions containing knowingly false information, slander, libel, hate speech, sexual or violent explicit content, or content harming the dignity of persons or entities related to horse racing.
- Impersonate another person, organization or entity, or falsely declare an affiliation.
- Upload images, texts or materials over which they do not hold sufficient rights or authorization, or for which there is no compatible licence.
- Carry out automated scraping, unauthorized mass indexing or attempt to reproduce the Site's content to build a derivative service of a commercial nature.
- Attempt to access restricted areas, manipulate moderation features or interfere with the Site's security.
- Overload the infrastructure with abnormal request volumes, abusive automation or denial-of-service tools.
- Promote betting, gambling, pyramid schemes, speculative crypto-assets or any financial product through Contributions, comments or public Site channels.
Failure to comply with these rules entitles the Operator to moderate, remove or edit Contributions, suspend or terminate the user account and, where appropriate, give notice to competent authorities.
7.User contributions
Contributions submitted by the User to the Site (edit suggestions, proposals for new entities, extra information, error reports, images and similar materials) are governed by the following rules:
a) User warranties. By submitting a Contribution, the User declares and warrants that: (i) they hold the necessary rights to submit it and authorize its publication, or hold a sufficient licence from the original holder; (ii) the Contribution does not infringe intellectual-property rights, image rights, privacy rights or any other third-party right; (iii) the information provided is true to the best of the User's knowledge and belief, and where verifiable data is concerned, will be accompanied by the corresponding source; (iv) it does not contain unlawful, offensive content or content contrary to these Terms.
b) Licence granted by the User. The User grants the Operator a worldwide, non-exclusive, royalty-free, sub-licensable, perpetual licence to reproduce, adapt, translate, distribute and publicly communicate the Contribution as part of the Editorial content of the Site, in any medium known or yet to be known. The licence extends to the inclusion of the Contribution in future versions of the Site, in mobile applications of the same project and in exports of the Editorial content under compatible open licences.
c) Editorial-content licence. Unless expressly stated otherwise, editorial texts published on the Site are offered under Creative Commons Attribution-ShareAlike 4.0 (CC BY-SA 4.0), with attribution to the Site and preservation of the licence in derivative works. Images may be subject to particular licences (e.g. Creative Commons in different versions, public domain or author-specific licences) which are indicated next to each image.
d) Attribution and editorial authorship. Contributions may be attributed to the author using the public name associated with the account. The User may at any time request anonymization of attribution without removing the Contribution from the Site.
e) Moderation, editing and rejection. The Operator reserves the right to accept, partially edit, translate, contextualize, archive or reject Contributions, with no obligation to provide a detailed explanation of moderation decisions. Decisions are made under reasonable editorial criteria aligned with the purpose of the Site.
8.Intellectual property
Distinctive signs — including the name Turfdex, the domain turfdex.com, the logo and graphic elements of the Site — are owned by the Operator and protected by Argentine trade-mark law and applicable international rules. Their use requires prior written authorization, except for purely referential or informational uses protected by law.
The software underlying the Site is protected by Argentine Law 11.723 on Intellectual Property and related rules. Its use by the User is limited to normal Site operation. Disassembly, reverse engineering, copying or redistribution of the software is forbidden unless expressly authorized or unless the components are offered by the Operator under open-source licences.
Editorial content is subject to the licence indicated in the previous section. Pure factual data (names, dates, official results) is not appropriable and is reproduced citing, where appropriate, the relevant official source.
9.Intellectual-property infringement notices
If you believe that content published on the Site infringes your intellectual-property rights (copyright, related rights, trade marks, image rights or others), you may send us a notice at contacto@turfdex.com. To make the notice actionable, we ask that it include:
- 1.Identification of the protected work or material whose right is invoked, with sufficient description to locate it (e.g. title, author, registration number if any).
- 2.Precise identification of the Site content considered infringing, indicating the full URL or exact locator.
- 3.Contact details of the notifier: full name, postal or e-mail address, and, where acting on behalf of someone else, evidence of representation.
- 4.Good-faith statement that the use of the material is not authorized by the rights holder, their representative or the law.
- 5.Statement that the information in the notice is accurate, under threat of applicable civil and criminal sanctions, and that the notifier owns the right invoked or is authorized to act on its behalf.
- 6.Physical or electronic signature of the notifier.
Once a compliant notice is received, we will assess the claim in good faith and, where appropriate, will remove or restrict access to the questioned content. When content was submitted by an identifiable user, we will notify the author to give them an opportunity to respond.
If you are the author of removed content and believe the removal was wrongful, you may send us a counter-notice through the same contact channel, including: identification of the removed content and its previous location, contact details, sworn statement that the removal resulted from error or misidentification, and consent to the competent jurisdiction to resolve any disputes. After a valid counter-notice we may restore the content where circumstances justify it, provided no judicial order to the contrary exists.
This procedure is inspired by international notice-and-take-down standards (including those provided for by the United States Digital Millennium Copyright Act for services covered by that statute, and by the European directives on electronic commerce and copyright). Its existence does not exclude other legal remedies that the holder of the invoked right may pursue.
10.Sources, accuracy and truthfulness of information
Turfdex makes effort and diligence to publish verifiable information, citing sources where data permits. However, part of the information comes from scattered historical sources, old records, oral testimony and community submissions. By their nature, such records may contain errors, inaccuracies or gaps.
The Operator does not guarantee the absolute accuracy, completeness or currency of editorial content. Information is offered "as is". If you spot an error, please report it through the contributions flow or by e-mail.
In no case must the published information be used as the sole basis for decisions with economic, health-related, professional sporting or legal consequences. For those purposes, official sources should be consulted.
11.Links to third-party sites
The Site may contain links to third-party websites (e.g. official bodies, registries, racetracks, documentary sources, institutional profiles). The Operator does not control those sites or endorse their contents and assumes no responsibility for their practices, availability or for damages that may arise from their use.
12.Availability and changes to the service
The Site is offered without guarantee of uninterrupted continuity or any specific service level. The Operator may carry out scheduled or unscheduled maintenance, suspend features in whole or in part, modify the design, architecture or scope of editorial content, or discontinue the service in whole or in part, at any time, without prior notice.
To the extent reasonable, significant changes will be communicated through the Site or usual channels (including the public changelog).
13.Limitation of liability
To the maximum extent permitted by applicable law, the Operator shall not be liable for indirect damages, lost profits, lost opportunities, loss of data or moral damages arising from the use of or inability to use the Site, the inaccuracy of information, the interruption of the service or the conduct of third parties.
In particular, the Operator shall not be liable for financial losses arising from betting or gambling decisions made by the User or by third parties on the basis of information published on the Site. We reiterate that Turfdex is not a betting site and that its content must not be used for that purpose.
These limitations apply without prejudice to liability for wilful misconduct or any obligation that, under applicable law, cannot be limited contractually.
14.Indemnity
The User undertakes to hold the Operator harmless against any claim, demand, sanction or expense (including reasonable professional fees) arising from (i) the User's breach of these Terms, (ii) failure to comply with applicable law in using the Site, (iii) infringement of third-party rights through Contributions submitted by the User, or (iv) misuse of the Site or of the published information.
15.Suspension and termination by the Operator
The Operator may suspend or cancel a User account, restrict access to the Site or remove Contributions in any of the following cases: (i) breach of these Terms; (ii) fraudulent or suspicious activity; (iii) reasoned request from competent authorities; (iv) protection of the Operator's, other Users' or third-party rights.
To the extent reasonable, the Operator will inform the User of the reasons and timing of the measure adopted, except when the very nature of the facts or regulatory requirements prevent or advise against doing so.
16.Modifications to these Terms
The Operator may modify these Terms to reflect changes in Site operations, in features offered or in applicable law. When a modification implies substantial changes to User rights or obligations, it will be notified through a visible notice on the Site before its entry into force.
Continued use of the Site after the new version's effective date implies acceptance of the modifications. If the User does not agree, they shall refrain from using the Site and, where appropriate, request account deletion.
17.Integrity, severability and waiver
If any provision of these Terms is declared invalid, illegal or unenforceable by a competent authority, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force. Failure or delay in exercising any right under these Terms shall not be construed as a waiver of such right.
These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between the Operator and the User regarding use of the Site and supersede any previous agreement, communication or understanding between the parties on the same matter.
18.Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic, expressly waiving any other legislation that might apply.
Any dispute arising from the interpretation or application of these Terms will be submitted to the national ordinary courts with seat in the City of Buenos Aires, waiving any other forum or jurisdiction that might apply.
This clause applies without prejudice to mandatory consumer rights that may apply under the law of the User's country of residence and that cannot be limited or waived contractually. In particular, the User retains the right to bring proceedings before the consumer-protection forum or authority of their domicile when local consumer-protection law so requires on a mandatory basis, and to invoke the public-order rules in force in their jurisdiction.
